By accessing or using the AssociationMailer website (associationmailer.com) and services operated by Forest Printing ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

Services Description

AssociationMailer provides print and mail services including but not limited to: HOA newsletter printing and mailing, bulk mailing, direct mail marketing, design services, and rush mailing services. Service availability, pricing, and specifications are subject to change.

Quotes and Orders

  • All quotes are valid for 30 days from the date of issue unless otherwise stated.
  • Quotes are based on the specifications provided. Changes to specifications may result in revised pricing.
  • An order is considered confirmed upon written or electronic approval of a quote by the client.
  • We reserve the right to decline any order at our discretion.

Pricing and Payment

  • Prices are quoted in U.S. dollars and do not include applicable taxes unless stated.
  • Payment terms are net 30 days from the invoice date unless otherwise agreed in writing.
  • Late payments may be subject to a service charge of 1.5% per month or the maximum allowed by law, whichever is less.
  • We reserve the right to suspend services for past-due accounts.

Content and Materials

  • Clients are responsible for providing accurate and complete content and mailing lists for their projects.
  • We are not responsible for errors in client-provided materials that were not caught during the proofing process.
  • Clients warrant that all materials submitted for printing and mailing do not violate any laws or infringe on any third-party rights.
  • We reserve the right to refuse to print or mail any content that we deem unlawful, offensive, or otherwise objectionable.

Proofing and Approval

We provide digital proofs for client review and approval before production begins. It is the client's responsibility to review proofs carefully. Once a proof is approved, we are not liable for errors that were present in the approved proof.

Delivery and Turnaround

  • Estimated turnaround times are provided in good faith but are not guaranteed unless explicitly stated in writing.
  • We are not responsible for delays caused by USPS, other carriers, or circumstances beyond our control.
  • Rush services are available for an additional fee and are subject to equipment and staff availability.

Intellectual Property

All content on the AssociationMailer website, including text, graphics, logos, and software, is the property of Forest Printing or its content suppliers and is protected by U.S. and international copyright laws. Custom designs created by our team for client projects remain our property until full payment is received.

Limitation of Liability

To the maximum extent permitted by law, AssociationMailer and Forest Printing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of the cause of action.

Our total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Forest Printing and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of our website or services or your violation of these terms.

Website Use

  • You may use our website for lawful purposes only.
  • You may not use our website to transmit harmful or malicious content.
  • We do not guarantee uninterrupted or error-free access to our website.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Orange County, California.

Changes to These Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised terms.
